A 42-year-old Cheyenne man was taken into custody late Wednesday night after allegedly shooting at a tree and then holding police at bay for several hours at his home.

According to Laramie County Sheriff's Office spokesman Brandon Warner, the incident started when deputies were called out to the area of 4400 Greenfield Court just before 3:30 p.m. on a report of shots being fired. Someone reported that 42-year-old Brian Kuzma had shot at a tree in his front yard.

When deputies got there, they found out that Kuzma had threatened one of the residents of the area. By the time they got there, Kuzma had left. They learned he was at his home in the 5300 Block of Imperial Court in Cheyenne.

Once they confirmed he was inside, they called him and set up a perimeter around the home. The Cheyenne Police Department/Laramie County Sheriff’s Office Joint SWAT Team and Joint Crisis Negotiation Unit showed up to help.

Kuzma Refused To Come Out When Gas Was Deployed

But even though negotiators kept in touch with him on the phone, they weren't able to talk him into surrendering. OC gas [similar to pepper spray] was used to try to get him to come out, but he stubbornly refused to surrender.

According to Warner "A forced entry was made into the residence. A K9 unit assisted with the apprehension. Kuzma was taken into custody, transported to the Laramie Detention Center, and arrested on charges on charges of aggravated assault and stalking."

All suspects are presumed innocent until proven guilty in a court of law."
