A pilot for SkyWest Airlines was arrested Wednesday morning for being over the legal alcohol limit to fly, according to a news release from the Rapid City, S.D., Police Department.

That flight, SkyWest 4574, from Rapid City to Salt Lake City would have crossed Wyoming.

Rapid City police responded to a report shortly after 8 a.m. about a pilot smelling of alcohol at the Rapid City Regional Airport.

Police determined the pilot was in violation of the federal law that prohibits a pilot from having a blood alcohol concentration over .04 percent. The legal limit for motorists is .08 percent.

They arrested Russel Duszak, 38, of Salt Lake City for operating an aircraft under the influence of alcohol.

The Rapid City Journal reported Duszak was released after posting a $300 bond.  SkyWest, under contract with Delta Airlines, was placed on administrative leave.

The flight, with 45 passengers, was delayed for two-and-a-half hours before taking off.
